The Equality Act has clarified that health problems caused by unusual body processes can count as disabilities. Because of this, obesity might sometimes be seen as a disability, depending on the situation. This is similar to past confusion about whether diabetes counts as a disability.

This means employers must look at each person individually to decide if their condition is a disability when hiring. If an obese person is significantly affected by their condition, they might have a right to reasonable adjustments at work. Hiring decisions should be based on how a condition affects a person in practice, not on assumptions or stereotypes.

This growing recognition of obesity as a possible disability highlights the importance of fair, respectful, and non-discriminatory hiring practices.
